On the 1st of December 2015 a training for judges of the general jurisdiction started at the premises of the State Enterprise “Ukrainian Intellectual Property Institute” (Ukrpatent), organized in the framework of the EU-funded Twinning Project “Strengthening the protection and enforcement of intellectual property rights in Ukraine”.
On the 1st of December 2015 a training for judges of the general jurisdiction started at the premises of the State Enterprise “Ukrainian Intellectual Property Institute” (Ukrpatent), organized in the framework of the EU-funded Twinning Project “Strengthening the protection and enforcement of intellectual property rights in Ukraine”.
Representatives of the judiciary were invited to participate in the course, among them those from the Higher specialized court of Ukraine for civil and criminal cases, Appellate court of Kyiv, district courts of Kyiv, appellate courts from various regions of Ukraine.
Head of the State Intellectual Property Service of Ukraine, Mrs. Alla Zharinova, noted when commenting the event:
- I am sure that a fruitful cooperation between Ukrainian and Spanish colleagues within this trainings will contribute not only to the Ukrainian side, but to the European one as well; the Twinning Project foresees a bilateral exchange of experience between its participants. I believe that our judges have a lot to share with their European counterparts.
During the training, held by Mr. Angel Galgo, head of the Appellate Commercial court of Madrid and Mr. Enrique Garcia Chamon, head of the Appelate Commercial court of Alicante, Ukrainian experts will have a unique opportunity to discover the main basics and principles of the legal protection and enforcement for industrial property in the EU, learn from the first-person perspective about real cases of judicial practice in Spain and the EU for patents, trademarks, copyright and related rights.
While opening the training, Mr. Pablo Rodenas, Resident Twinning Adviser, expressed his gratitude to the Spanish experts for the opportunity to meet high level judges, who have several years of experience in cases related to the intellectual property in the EU. According to Mr. Rodenas, the main goal of the seminars and trainings organized within the Twinning Project is to provide Ukrainian counterparts with all necessary information concerning the acquis communautaire in the field of IPR and to ensure an active exchange of experience.
The information received in the framework of this training may soon be used by the judges on practice, after the entry into force of the DCFTA..
In his introductory speech Mr. Angel Galgo underlined that current Ukrainian situation reminds him much of the one Spain had before entering the EU: back at the Spanish state had to undertake a significant reform and harmonization of legislation in order to ensure the enforcement of IPR due at the European level.
According to Mr. Galgo, the high level of competences among the judiciary plays a pivotal role in a successful implementation of the abovementioned missions: it is important to coordinate the efforts of both systems – national and European one.
The training programme for the judges of general jurisdiction is to last three days.
